1) Data collection when visiting our website

If you use our website for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect data that your browser transmits to our server (so-called "server log files"). When you visit our website, we collect the following data, which is technically necessary for us to display the website to you:

The processing is carried out in accordance with Art. 6 (1) (f) GDPR on the basis of our legitimate interest in improving the stability and functionality of our website. The data will not be passed on or used in any other way. However, we reserve the right to subsequently check the server log files if there are concrete indications of illegal use. 



2) Cookies

In order to make visiting our website more attractive and to enable the use of certain functions, we use so-called cookies on various pages. These are small text files that are stored on your device. Some of the cookies we use are deleted after the end of the browser session, i.e. after you close your browser (so-called session cookies). Other cookies remain on your device and enable your browser to be recognized the next time you visit (so-called persistent cookies). If cookies are set, they collect and process certain user information to an individual extent, such as browser and location data as well as IP address values. Persistent cookies are automatically deleted after a specified period of time, which can vary depending on the cookie. 3) Contact us

When you contact us (e.g. via contact form or email), personal data is collected. The data collected in the case of a contact form can be seen from the respective contact form. This data is stored and used exclusively for the purpose of answering your request or for establishing contact and the associated technical administration. The legal basis for the processing of this data is Art. 6 Para. 1 lit. b GDPR (necessary for carrying out pre-contractual measures). Your data will be deleted 3 years after your request has been finally processed.

4) Data processing for contract execution

In accordance with Art. 6 Paragraph 1 Letter b of GDPR, personal data is collected and processed when you provide it to us for the performance of a contract. Which data is collected can be seen from the respective order form. We store and use the data you provide to process the contract. After the contract has been fully processed or your customer account has been deleted, your data will be deleted in accordance with tax and commercial retention periods (currently 7 years).

5) Use of your data for direct marketing

5.1 Registration for our email newsletter

If you sign up for our email newsletter, we will regularly send you information about our offers. The only mandatory information for sending the newsletter is your email address. 

By registering, you give us your consent to use your personal data in accordance with Art. 6 Paragraph 1 Letter a of GDPR. When you register for the newsletter, we save your IP address entered by your Internet Service Provider (ISP) as well as the date and time of registration in order to be able to trace any possible misuse of your email address at a later date. The data we collect when you register for the newsletter is used exclusively for the purposes of advertising in the newsletter. You can unsubscribe from the newsletter at any time using the link provided for this purpose in the newsletter or by sending us a corresponding message. After unsubscribing, your email address will be immediately deleted from our newsletter distribution list.

5.2 Sending the email newsletter to existing customers

If you have provided us with your email address when purchasing goods or services, we reserve the right to regularly send you offers for similar goods or services from our range to those you have already purchased by email. In accordance with Section 174 of the Telecommunications Act (TKG), we do not need to obtain your separate consent for this. In this respect, data processing is carried out solely on the basis of our legitimate interest in personalized direct advertising in accordance with Art. 6 Paragraph 1 Letter f of GDPR and Section 174 of the Telecommunications Act (TKG). If you initially objected to the use of your email address for this purpose, we will not send you any emails. You are entitled to object to the use of your email address for the aforementioned advertising purpose at any time with effect for the future by notifying us. 

5.3 Newsletter dispatch via MailChimp
Our e-mail newsletters are sent via the technical service provider The Rocket Science Group, LLC d/b/a MailChimp, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA (http://www.mailchimp.com/ ), to whom we pass on the data you provided when registering for the newsletter. This transfer takes place in accordance with Art. 6 Para. 1 lit. f GDPR and serves our legitimate interest in using an effective, secure and user-friendly newsletter system. Please note that your data is usually transferred to a MailChimp server in the USA and stored there.
MailChimp uses this information to send newsletters on our behalf. MailChimp does not use the data of our newsletter recipients to write to them directly or to pass it on to third parties.
To protect your data in the USA, we have concluded a data processing agreement with MailChimp based on the European Commission's standard contractual clauses to enable the transmission of your personal data to MailChimp. 5.4 Newsletter dispatch via Shopify Email
Our email newsletters are sent via Shopify Email, a service of Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland ("Shopify"), to which we pass on the data you provided when registering for the newsletter. This transfer takes place in accordance with Art. 6 Paragraph 1 Letter f of GDPR and serves our legitimate interest in using an effective, secure and user-friendly newsletter system. The data you enter to subscribe to the newsletter (e.g. email address) is generally stored on Shopify's servers in the EU. .
As part of the aforementioned Shopify services, data may also be transmitted to Shopify Inc., 150 Elgin St, Ottawa, ON K2P 1L4, Canada, Shopify Data Processing (USA) Inc., Shopify Payments (USA) Inc. or Shopify (USA) Inc. as part of further processing on behalf of Shopify. In the event that data is transmitted to Shopify Inc. in Canada, the appropriate level of data protection is guaranteed by the European Commission's adequacy decision.
Shopify uses this information to send and statistically evaluate the newsletter on our behalf. For the evaluation, the emails sent may contain so-called web beacons or tracking pixels, which are single-pixel image files stored on our website. This makes it possible to determine whether a newsletter message has been opened and which links have been clicked. Technical information is also recorded (e.g. time of retrieval, IP address, browser type and operating system). The data is collected exclusively in pseudonymized form and is not linked to your other personal data; direct personal reference is excluded. This data is used exclusively for the statistical analysis of newsletter campaigns. The results of these analyses can be used to better tailor future newsletters to the interests of the recipients. If you wish to object to data analysis for statistical evaluation purposes, you must unsubscribe from the newsletter.
Furthermore, Shopify can use this data itself in accordance with Art. 6 (1) (f) GDPR based on its own legitimate interest in the needs-based design and optimization of the service as well as for market research purposes, for example to determine which countries the recipients come from. However, Shopify does not use the data of our newsletter recipients to write to them directly or to pass the data on to third parties.
We have concluded a data processing agreement with Shopify, which requires Shopify to protect our customers' data and not to pass it on to third parties.

6) Data processing for order processing

6.1 To the extent necessary for the execution of the contract for delivery and payment purposes, the personal data collected by us will be passed on to the commissioned transport company and the commissioned credit institution in accordance with Art. 6 Paragraph 1 Letter b of GDPR.

To process your order, we also work with the following service provider(s), who support us in whole or in part in the implementation of concluded contracts. Certain personal data is transmitted to these service providers in accordance with the following information.

6.2 Use of special service providers for order processing and handling

Billbee
Order processing is carried out by the service provider "Billbee" (Billbee GmbH, Arolser Str. 10, 34477 Twistetal). Name, address and any other personal data will be passed on to Billbee in accordance with Art. 6 Paragraph 1 Letter b of GDPR solely for the purpose of processing the online order. Your data will only be passed on if this is actually necessary for processing the order. 6.3 Transfer of personal data to shipping service providers

DPD
If the goods are delivered by the transport service provider DPD (DPD Direct Parcel Distribution Austria Gmbh, 2333 Leopoldsdorf near Vienna), we will pass on your e-mail address and telephone number to DPD before the goods are delivered in accordance with Art. 6 Para. 1 lit. a GDPR for the purpose of coordinating a delivery date or to notify you of the delivery, and we will pass on the name of the recipient and the delivery address to DPD for the purpose of delivery in accordance with Art. 6 Para. 1 lit. b GDPR.

6.4 Use of payment service providers (payment services)

Paypal
When paying via PayPal, credit card via PayPal, direct debit via PayPal or - if offered - "purchase on account" or "payment in installments" via PayPal, we pass on your payment data to PayPal (Europe) Sarl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter "PayPal") as part of the payment processing. The data is passed on in accordance with Art. 6 Para. 1 lit. b GDPR and only to the extent that this is necessary for the payment processing.
PayPal reserves the right to carry out a credit check for the payment methods credit card via PayPal, direct debit via PayPal or - if offered - "purchase on account" or "installment payment" via PayPal. For this purpose, your payment data may be passed on to credit agencies in accordance with Art. 6 Paragraph 1 Letter f of GDPR on the basis of PayPal's legitimate interest in determining your ability to pay. PayPal uses the result of the credit check in relation to the statistical probability of default for the purpose of deciding on the provision of the respective payment method. The credit report may contain probability values ​​(so-called score values). Insofar as score values ​​are included in the result of the credit report, they are based on a scientifically recognized mathematical-statistical procedure. You can object to this processing of your data at any time by sending a message to PayPal. However, PayPal may still be entitled to process your personal data if this is necessary for the contractual payment processing.

Klarna
If you select a Klarna payment service, payment will be processed via Klarna Bank AB (publ), https://www.klarna.com/de/ , Sveavägen 46, 111 34 Stockholm, Sweden (hereinafter "Klarna"). Stripe

Stripe reserves the right to carry out a credit check based on mathematical-statistical procedures in order to protect the legitimate interest in determining the user's ability to pay. However, Stripe may still be entitled to process your personal data if this is necessary to process payments in accordance with the contract.

 Apple Pay
If you choose the payment method “Apple Pay” from Apple Distribution International (Apple), Hollyhill Industrial Estate, Hollyhill, Cork, Ireland, the payment will be processed using the “Apple Pay” function on your iOS, watchOS or macOS device by charging a payment card stored with “Apple Pay”. Apple Pay uses security features that are integrated into the hardware and software of your device to protect your transactions. To authorize a payment, you must enter a code that you have previously specified and verify it using the “Face ID” or “Touch ID” function on your device.
For the purpose of payment processing, the information you provided during the ordering process, along with information about your order, will be passed on to Apple in encrypted form. Apple then encrypts this data again with a developer-specific key before the data is transmitted to the payment service provider of the payment card stored in Apple Pay to carry out the payment. The encryption ensures that only the website through which the purchase was made can access the payment data. After the payment has been made, Apple sends your device account number and a transaction-specific, dynamic security code to the source website to confirm the payment success. .
If personal data is processed during the transmissions described, the processing is carried out exclusively for the purpose of payment processing in accordance with Art. 6 (1) lit. b GDPR .
Apple stores anonymized transaction data, including the approximate purchase amount, the approximate date and time, and whether the transaction was completed successfully. Anonymization completely excludes any personal reference. Apple uses the anonymized data to improve Apple Pay and other Apple products and services.

When you use Apple Pay on iPhone or Apple Watch to complete a purchase you made through Safari on Mac, the Mac and the authorization device communicate over an encrypted channel on Apple servers. Apple does not process or store any of this information in a format that can identify you. You can turn off the ability to use Apple Pay on your Mac in your iPhone's settings. Go to Wallet & Apple Pay and turn off Allow Payments on Mac.

EPS transfer
If you select the payment method “EPS transfer”, the payment will be processed via the payment service provider PSA Payment Services Austria GmbH, Handelskai 92, Gate 2, 1200 Vienna, Austria, to whom we will pass on the information you provided during the ordering process, along with the information about your order, in accordance with Art. 6 Paragraph 1 Letter b of GDPR. Google Pay
If you choose the payment method “Google Pay” from Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”), the payment will be processed via the “Google Pay” application on your mobile device running at least Android 4.4 (“KitKat”) and with an NFC function by charging a payment card stored with Google Pay or a payment system verified there (e.g. PayPal). To authorize a payment via Google Pay of more than €25, your mobile device must first be unlocked using the verification measure set up in each case (e.g. facial recognition, password, fingerprint or pattern).
For the purpose of payment processing, the information you provided during the ordering process, along with information about your order, will be passed on to Google. Google then transmits your payment information stored in Google Pay to the source website in the form of a unique transaction number, which is used to verify that the payment has been made. This transaction number does not contain any information about the actual payment data of your payment method stored with Google Pay, but is created and transmitted as a one-time numerical token. For all transactions via Google Pay, Google acts only as an intermediary to process the payment process. The transaction is carried out exclusively in the relationship between the user and the source website by charging the payment method stored with Google Pay.
If personal data is processed during the transmissions described, the processing is carried out exclusively for the purpose of payment processing in accordance with Art. 6 (1) (b) GDPR.
Google reserves the right to collect, store and evaluate certain transaction-specific information for each transaction made through Google Pay. This includes the date, time and amount of the transaction, the merchant location and description, a description of the goods or services purchased provided by the merchant, photos that you have attached to the transaction, the name and email address of the seller and buyer or the sender and recipient, the payment method used, your description of the reason for the transaction and, if applicable, the offer associated with the transaction.
According to Google, this processing is carried out exclusively in accordance with Art. 6 (1) (f) GDPR on the basis of the legitimate interest in proper accounting, the verification of transaction data and the optimization and maintenance of the functionality of the Google Pay service.
Google also reserves the right to merge the processed transaction data with other information that is collected and stored by Google when using other Google services.

Mollie
If you choose a payment method from the payment service provider Mollie, the payment will be processed via the payment service provider Mollie BV, Keizersgracht 313, 1016 EE Amsterdam, Netherlands, to whom we will pass on the information you provided during the ordering process, along with information about your order (name, address, IBAN, BIC, invoice amount, currency and transaction number) in accordance with Art. 6 (1) (b) GDPR. Your data will be passed on exclusively for the purpose of payment processing with the payment service provider Mollie and only to the extent that it is necessary for this purpose.

7) Online Marketing

7.1 Facebook Pixel
Our online offering uses the so-called “Facebook pixel” of the social network Facebook, which is operated by Meta Platforms Ireland Limited, 4 Grand Canal Quare, Dublin 2, Ireland (“Facebook”).
If a user clicks on an ad placed by us that is displayed on Facebook, an extension is added to the URL of our linked page using Facebook Pixel. If our page allows data to be shared with Facebook via Pixel, this URL parameter is written into the user's browser using a cookie that our linked page itself sets. This cookie is then read by Facebook Pixel and enables the data to be forwarded to Facebook.
With the help of the Facebook pixel, Facebook is able to determine the visitors to our online offering as a target group for the display of advertisements (so-called "Facebook ads"). Accordingly, we use the Facebook pixel to only display the Facebook ads placed by us to those Facebook users who have also shown an interest in our online offering or who have certain characteristics (e.g. interests in certain topics or products determined based on the websites visited) that we transmit to Facebook (so-called "custom audiences"). With the help of the Facebook pixel, we also want to ensure that our Facebook ads correspond to the potential interests of users and do not appear annoying. In this way, we can further evaluate the effectiveness of Facebook advertisements for statistical and market research purposes by tracking whether users were redirected to our website after clicking on a Facebook advertisement (so-called "conversion").
The data collected is anonymous to us and does not allow us to draw any conclusions about the identity of the user. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook data usage policy ( https://www.facebook.com/about/privacy/ ). The data can enable Facebook and its partners to place advertisements on and outside of Facebook.

7.2 - Google Ads
This website uses the online advertising program "Google Ads" and, as part of Google Ads, the conversion tracking of Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"). We use the Google Ads service to draw attention to our attractive offers on external websites using advertising materials (so-called Google Adwords). We can determine how successful the individual advertising measures are in relation to the data from the advertising campaigns. The cookie for conversion tracking is set when a user clicks on an Ads ad placed by Google. Cookies are small text files that are stored on your device. These cookies usually expire after 30 days and are not used for personal identification. If the user visits certain pages of this website and the cookie has not yet expired, Google and we can recognize that the user clicked on the ad and was redirected to this page. When using Google Analytics 4, the IP address transmitted by your device when you use the website is automatically and always collected and processed anonymously, so that the information collected cannot be directly linked to a person. This automatic anonymization takes place by shortening the last digits of the IP address transmitted by your device by Google within member states of the European Union (EU) or other contracting states to the Agreement on the European Economic Area (EEA).
On our behalf, Google uses this and other information to evaluate your use of the website, to compile reports on your website activities or usage behavior, and to provide us with other services related to your website usage and internet usage. The IP address transmitted and shortened by your device as part of Google Analytics 4 will not be merged with other Google data. The data collected as part of the use of Google Analytics 4 will be stored for 2 months and then deleted.
Google Analytics 4 also uses a special function called "demographic features" to create statistics with information about the age, gender and interests of website users based on an evaluation of interest-based advertising and with the use of third-party information. This makes it possible to determine and differentiate user groups of the website for the purpose of targeting marketing measures that are optimized for specific groups. However, data collected via "demographic features" cannot be assigned to a specific person and therefore cannot be assigned to you personally. This data collected via the "demographic features" function is stored for two months and then deleted.
All processing described above, including data transfers via “pings” and
the possible setting of Google Analytics cookies for the storage and possible reading of information on the device you use to use the website, only takes place if you have given us your express consent to do so in accordance with Art. 6 Paragraph 1 Letter a of GDPR. Without your consent, your use of the website will not be analyzed. You can revoke your consent at any time with effect for the future. To exercise your revocation, please deactivate this service using the "Cookie Consent Tool" provided on the website.
We have concluded a so-called order processing agreement with Google for our use of Google Analytics 4, through which Google is obliged to protect the data of our website users and not to pass it on to third parties.
To ensure compliance with European data protection standards, including when data is transferred from the EU or EEA to the USA and when it is further processed there, Google relies on the so-called standard contractual clauses of the European Commission, which we have contractually agreed with Google.

9) Tools and Others

Google Maps
On our website we use Google Maps (API) from Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”). Google Maps is a web service for displaying interactive (land) maps to visually represent geographical information. Using this service will show you our location and make it easier to find us.
As soon as you access the subpages in which the Google Maps map is integrated, information about your use of our website (such as your IP address) is transmitted to Google servers and stored there. This may also involve transmission to the servers of Google LLC in the USA. This occurs regardless of whether Google provides a user account through which you are logged in or whether a user account already exists. If you are logged in to Google, your data will be assigned directly to your account. If you do not wish to be assigned to your Google profile, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and evaluates them. The collection, storage and evaluation are carried out in accordance with Art. 6 Para. 1 lit. f GDPR on the basis of Google's legitimate interest in displaying personalized advertising, market research and/or the needs-based design of Google websites. You have the right to object to the creation of these user profiles, but you must contact Google to exercise this right. If you do not agree to the future transmission of your data to Google when using Google Maps, you also have the option of completely deactivating the Google Maps web service by disabling the JavaScript application in your browser. Google Maps and thus the map display on this website cannot then be used.

10) Hosting 

Hosted by Shopify
We use the shop system of the service provider Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland ("Shopify"), for the purpose of hosting and displaying the online shop on the basis of processing on our behalf. All data collected on our website is processed on Shopify's servers. As part of the aforementioned services from Shopify, data can also be transmitted to Shopify Inc., 150 Elgin St, Ottawa, ON K2P 1L4, Canada, Shopify Data Processing (USA) Inc., Shopify Payments (USA) Inc. or Shopify (USA) Inc. as part of further processing on behalf of Shopify. In the event that data is transmitted to Shopify Inc. in Canada, the appropriate level of data protection is guaranteed by the European Commission's adequacy decision. Further processing on Shopify servers other than those mentioned above will only take place within the scope communicated below.

11) Rights of the data subject

11.1 The applicable data protection law grants you comprehensive rights as a data subject vis-à-vis the controller with regard to the processing of your personal data, about which we will inform you below:

  • Right to information in accordance with Art. 15 GDPR: In particular, you have the right to information about your personal data processed by us, the purposes of the processing, the categories of personal data processed, the recipients or categories of recipients to whom your data has been or will be disclosed, the planned storage period or the criteria for determining the storage period, the existence of a right to rectification, erasure, restriction of processing, objection to processing, complaint to a supervisory authority, the origin of your data if it was not collected from you by us, the existence of automated decision-making including profiling and, if applicable, meaningful information about the logic involved and the scope and intended effects of such processing concerning you, as well as your right to be informed of the guarantees in accordance with Art. 46 GDPR when your data is forwarded to third countries;
  • Right to rectification in accordance with Art. 16 GDPR: You have the right to have inaccurate data concerning you rectified without delay and/or to have incomplete data stored by us completed;
  • Right to erasure in accordance with Art. 17 GDPR: You have the right to request the erasure of your personal data if the requirements of Art. 17 Para. 1 GDPR are met. However, this right does not apply in particular if the processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
  • Right to restriction of processing in accordance with Art. 18 GDPR: You have the right to request the restriction of the processing of your personal data as long as the accuracy of your data, which you dispute, is being verified, if you refuse to delete your data due to inadmissible data processing and instead request the restriction of the processing of your data, if you need your data to assert, exercise or defend legal claims after we no longer need this data after the purpose has been achieved, or if you have lodged an objection for reasons related to your particular situation, as long as it has not yet been determined whether our legitimate reasons outweigh yours;
  • Right to information in accordance with Art. 19 GDPR: If you have asserted your right to rectification, erasure or restriction of processing vis-à-vis the responsible party, this party is obliged to inform all recipients to whom the personal data concerning you was disclosed of said rectification, erasure or restriction of processing, unless doing so should prove impossible or involve disproportionate expenditure. You have the right to be informed of these recipients.
  • Right to data portability in accordance with Art. 20 GDPR: You have the right to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request that it be transmitted to another controller, where technically feasible;
  • Right to revoke consent granted in accordance with Art. 7 Para. 3 GDPR: You have the right to revoke your consent to the processing of data at any time with effect for the future. In the event of revocation, we will delete the data concerned immediately unless further processing can be based on a legal basis for processing without consent. The revocation of consent does not affect the legality of the processing carried out on the basis of the consent until the revocation;
  • Right to complain in accordance with Art. 77 GDPR: If you believe that the processing of personal data concerning you violates the GDPR, you have - without prejudice to any other administrative or judicial remedy - the right to complain to a supervisory authority, in Austria the Data Protection Authority

11.2 Right of objection

If your personal data is processed based on our overriding interest, you have the right to object to this processing at any time with effect for the future. However, further processing remains reserved if there are compelling reasons for further processing.



12) Duration of storage of personal data

The duration for which personal data is stored is determined based on the respective legal basis, the purpose of processing and – if applicable – also on the respective statutory retention period (e.g. retention periods under company and tax law).

When personal data is processed on the basis of an explicit consent in accordance with Art. 6 (1) (a) GDPR, these data will be stored until the data subject revokes his or her consent.

If there are statutory retention periods for data that are processed within the framework of legal or quasi-legal obligations on the basis of Art. 6 (1) (b) GDPR, these data will be routinely deleted after expiry of the retention periods, provided that they are no longer required to fulfill or initiate a contract and/or we no longer have a legitimate interest in continuing to store them.

When processing personal data for the purpose of direct advertising on the basis of Art. 6 (1) (f) GDPR, these data will be stored until the data subject exercises his or her right of objection in accordance with Art. 21 (2) GDPR.

Unless otherwise stated in the other information in this declaration on specific processing situations, stored personal data will be deleted when they are no longer necessary for the purposes for which they were collected or otherwise processed.
